Can a foreigner register a trademark in Georgia?

How long does trademark registration take in Georgia, and can it be accelerated?

The standard registration takes approximately 11 months. However, the applicant may request an accelerated examination of the application. The accelerated examination process is carried out in ten business days.

What are trademark registration fees?

The fees for trademark registration are applied step by step. In total, standard trademark registration for one class of goods costs 420 USD. (Note that 50 USD is added for each additional class of goods)

For the accelerated procedure, the applicant has to pay 200 USD for the formal examination and 300 USD for the substantive examination. The publication, registration, and issuance of the certificate with the accelerated procedure cost 340 USD.

How long will a Georgian trademark be valid?

A trademark is registered for a period of 10 years, which may be extended indefinitely by consecutive periods of 10 years, after payment of the fee prescribed for extension of the term of validity.

Where does trademark protection apply?

A registered trademark is protected on the whole territory of Georgia. A trademark can also be protected internationally in two ways:

1. File an application directly with the relevant office of the country where the applicant wishes to acquire exclusive rights.

2. Extend the validity of the mark through Sakpatenti in any member office of the Madrid System. The Madrid System includes 108 member offices, covering 124 countries.

Can I register my Georgian trademark internationally?

Through the Madrid Protocol, a trademark registered in Georgia can be extended to protection in over 100 member countries through a single application. Alternatively, the Paris Convention allows you to use your Georgian filing date as the priority date in other member countries if you file within 6 months.
